Srinagar : Shah Faesal, an IAS officer whose recourse to social media attracted disciplinary action earlier, on Sunday compared Article 35A of the Constitution to a marriage deed or ‘nikahnama’.
“You repeal it and the relationship is over. Nothing will remain to be discussed afterwards,” Faesal said.
Responding to Faesal’s remarks, former Minister and Peoples Democratic Party leader Naeem Akhtar retweeted the comment and added his own views.
“Repealing it will be like marital rape. Converting a constitutional relationship into occupation.”
Separatist leaders who have all along maintained that they do not recognize the supremacy of the Indian Constitution over the state have also closed their ranks to fight for preservation of Article 35A.
Promulgated on May 14, 1954, the Article gives state legislature the power to define the permanent residents of the state and also their privileges.

Srinagar : The Jammu and Kashmir government on Tuesday initiated disciplinary action against the 2010 Indian Administrative Service (IAS) topper, Shah Faesal.
In an official communication to Shah Faesal who is presently in the US pursuing Edward S. Mason Mid-Career post graduate course at the prestigious Harvard University, Jammu and Kashmir General Administration Department said:
“The Centre’s Department of Personnel and Training has requested the state government to initiate an action against you.”
Shah Faesal has been voicing his opinion on the social media platform and he has been of the opinion that the rules prohibiting voicing of opinion on societal and governmental issues on social media by civil servants in India are monarchical and, therefore, need to be revisited immediately.

Rajiv Rautela, the District Magistrate of Gorakhpur, who courted controversy on Wednesday for barring the media from accessing details at the Lok Sabha bypoll counting centre, has been shifted and prompted as Divisional Commissioner of Devipatan.
The bureaucratic rejig was effected late on Friday.
