New Delhi: The Delhi High Court on Tuesday said BJP leader Subramanian Swamy’s plea, seeking directions to the Ministry of Home Affairs (MHA) to decide his representation seeking cancellation of Congress leader Rahul Gandhi’s Indian citizenship, be treated a public interest litigation.
At the outset, the court asked Swamy what his legally permissible right was in such a matter.
Justice Sanjeev Narula said it could only be a right, if at all it is, to be considered as a public interest and beyond that it cannot consider it.
“Mr Swamy I am not able to find any legally permissible right which can be enforced,” the judge said.
To this Swamy, who was arguing in person, said if the court feels that the plea be heard as a PIL, it was within the court’s power to send it to the bench dealing with public interest litigations.
“It is for the government of India. I am not doing it for my personal benefit,” he said.
He said the complaint made by him to the ministry was acknowledged and Rahul Gandhi was called upon to give his response to it.
However, since then there has been no progress or intimation given to the petitioner.
The court, dictating its order, said “For this court to exercise jurisdiction under Article 226 of the Constitution, enforceable constitutional rights must be demonstrated which the court cannot find.”

New Delhi: Congress leader Pawan Khera on Tuesday said the Bharatiya Janata Party is “violating the Constitutional norms from the backdoor” by making lateral entry appointments into bureaucracy which are devoid of representation for Dalits, Adivasi and Backward Classes.
The Modi government made 52 recruitments under lateral entry from 2017 to 2021, in which Dalits, Adivasi and Backward Classes did not get any representation, Khera, the Congress party’s spokesperson, told IANS.
The Congress has been critical of the Union Public Service Commission advertisement seeking recruitment of domain experts into bureaucracy and claimed that it was BJP’s “conspiracy” to deprive the unprivileged community of reaching top positions in government.
After Maharashtra’s Badlapur district recorded a heinous crime against two school girls, which triggered protest by locals, Khera taunted that he hoped that the BJP would be holding protests there also and demanding the resignation of the chief minister of the state.
According to the National Crime Records Bureau, crime against women has been increasing, and the Modi government should come forward and reply to it, he said.
On the National Conference promising in its manifesto revocation of Article 370 and statehood of Jammu and Kashmir, Khera said he cannot comment on the manifesto of the other party.

New Delhi: Amid row over Hindenburg’s allegations against Sebi chief Madhabi Buch, the Congress on Tuesday said regulatory failures and conflicts of interest may be brazened out briefly but they can cause long-term damage to the sentiment and confidence of investors.
The opposition party also said the Indian equity market has so far enjoyed fair weather due to well-regulated markets but any lapse risks destabilising them.
Congress general secretary-in-charge communications Jairam Ramesh said data released recently reveals that the unique registered investor base of the National Stock Exchange of India (NSE) with unique PANs has crossed 10 crore.
The median age of these investors is 32 years, and 40 per cent of all investors are below 30 years of age, Ramesh said, citing the NSE.
Financial markets function on the assumption that regulators will regulate fairly and companies will play by the rules, he said.

The Supreme Court on Tuesday, August 20, began hearing the Kolkata doctor rape and murder case and questioned if the nation was waiting for another rape to occur before implementing changes on the ground.
The three-member bench led by Chief Justice of India (CJI) D Y Chandrachud questioned the West Bengal government on the numerous delays and other procedural lapses pertaining to the case. It also questioned the safety of medical professionals, mainly female workers.
“Medical professions have become vulnerable to violence. Due to ingrained patriarchal biases, women doctors are targeted more. As more and more women join the workforce, the nation cannot wait for another rape for things to change on the ground,” CJI Chandrachud noted.
“Why was FIR registered three hours after the body was handed over for cremation,” the Supreme Court bench asked.
The alleged brutal rape and murder of a 31-year-old postgraduate trainee doctor that took place on August 9 in Kolkata’s RG Kar Medical College has taken the country by storm with nationwide protests from the medical fraternity.
